We operate the website https://roamease.live (the 'Site'), the mobile application RoamEase (the 'App'), as well as any other related products and services that refer or link to these legal terms (the 'Legal Terms') (collectively, the 'Services').

RoamEase is a comprehensive hostel management application that streamlines communication and daily operations between students and hostel authorities. It offers features including:

  • Leave management
  • Digital hostel ID
  • Vehicle pass
  • Blood emergency assistance
  • Visitor management
  • Community interaction
  • Complaint handling
  • Announcements
  • Bill splitting
  • Real-time notifications

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ('you'), and RoamEase, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms will become effective upon posting or notifying you by email. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the 'Content'), as well as the trademarks, service marks, and logos contained therein (the 'Marks').

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties around the world.

The Content and Marks are provided in or through the Services 'AS IS' for your personal, non-commercial use or internal business purpose only.

Your use of our Services

Subject to your compliance with these Legal Terms, including the 'PROHIBITED ACTIVITIES' section below, we grant you a non-exclusive, non-transferable, revocable licence to:

  • access the Services; and
  • download or print a copy of any portion of the Content to which you have properly gained access,

solely for your personal, non-commercial use or internal business purpose.

Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

  • You have the legal capacity and you agree to comply with these Legal Terms
  • You are not a minor in the jurisdiction in which you reside
  • You will not access the Services through automated or non-human means, whether through a bot, script or otherwise
  • You will not use the Services for any illegal or unauthorized purpose
  • Your use of the Services will not violate any applicable law or regulation

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

4. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to create or compile a collection, compilation, database, or directory without written permission
  • Trick, defraud, or mislead us and other users, especially in attempts to learn sensitive account information
  • Circumvent, disable, or interfere with security-related features of the Services
  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services
  • Use information from the Services to harass, abuse, or harm another person
  • Make improper use of our support services or submit false reports
  • Use the Services in a manner inconsistent with applicable laws
  • Engage in unauthorized framing of or linking to the Services
  • Upload or transmit viruses or other harmful material
  • Engage in any automated use of the system
  • Delete copyright or other proprietary rights notices
  • Attempt to impersonate another user
  • Interfere with, disrupt, or create undue burden on the Services
  • Harass, annoy, intimidate, or threaten our employees or agents
  • Attempt to bypass measures preventing or restricting access to the Services
  • Copy or adapt the Services' software
  • Decipher, decompile, disassemble, or reverse engineer any software comprising the Services
  • Use any unauthorized automated system to access the Services
  • Use a buying agent to make purchases on the Services
  • Make unauthorized use of the Services including collecting user information
  • Use the Services to compete with us or for any revenue-generating endeavor

App-Specific Prohibitions

  • Impersonating other individuals or providing false information
  • Sharing offensive, abusive, or inappropriate content
  • Attempting to hack or gain unauthorized access
  • Uploading viruses or harmful code
  • Using the app for illegal or unethical purposes
  • Harassing other users or hostel authorities
  • Misusing emergency services features
  • Circumventing security measures
  • Posting promotional content without permission
  • Using the app to disturb the hostel community

5. USER GENERATED CONTRIBUTIONS

The Services may invite you to contribute content including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information (collectively, 'Contributions'). Contributions may be viewable by other users of the Services.

When you create or make available any Contributions, you thereby represent and warrant that:

  • Your Contributions do not infringe proprietary rights of any third party
  • You have necessary licenses, rights, consents, and permissions
  • You have consent for any identifiable individuals in your Contributions
  • Your Contributions are not false, inaccurate, or misleading
  • Your Contributions are not unsolicited or unauthorized advertising
  • Your Contributions are not obscene, lewd, lascivious, filthy, violent, or harassing
  • Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone
  • Your Contributions are not used to harass or threaten
  • Your Contributions do not violate any applicable law
  • Your Contributions do not violate privacy or publicity rights
  • Your Contributions do not violate laws concerning child pornography
  • Your Contributions do not include offensive comments connected to protected classes

Any use of the Services in violation of these terms may result in termination or suspension of your rights to use the Services.

6. CONTRIBUTION LICENSE

By posting Contributions, you automatically grant us an unrestricted, worldwide, royalty-free license to:

  • Use, copy, reproduce, disclose, sell, and distribute your Contributions
  • Publicly perform, display, reformat, translate, and excerpt your Contributions
  • Prepare derivative works of or incorporate into other works
  • Grant sublicenses of the foregoing

License Details

This license applies to any form, media, or technology now known or hereafter developed. You waive all moral rights in your Contributions.

Note: We do not assert ownership over your Contributions. You retain full ownership of all your Contributions and any intellectual property rights. You are solely responsible for your Contributions.

Content Moderation

We have the right to:

  1. Edit, redact, or otherwise change any Contributions
  2. Re-categorize Contributions to more appropriate locations
  3. Pre-screen or delete any Contributions at any time without notice

We have no obligation to monitor your Contributions.

7. MOBILE APPLICATION LICENSE

Use License

If you access the Services via the App, we grant you a revocable, non-exclusive, non-transferable, limited right to:

  • Install and use the App on your devices
  • Access and use the App strictly according to these terms

License Restrictions

You shall not:

  • Decompile, reverse engineer, or attempt to derive source code
  • Make modifications or derivative works
  • Violate applicable laws in connection with your use
  • Remove, alter, or obscure any proprietary notices
  • Use for revenue-generating endeavors
  • Make available over a network for multiple users
  • Create competitive products or services
  • Use to send automated queries or unsolicited email
  • Use our intellectual property in competing applications

App Store Terms

Additional terms apply when using the App from app distributors:

  • License is limited to iOS/Android devices per distributor terms
  • We provide maintenance/support as specified here
  • For warranty claims, contact the app distributor
  • You represent compliance with export restrictions
  • You must comply with third-party terms (e.g., VoIP apps)
  • App distributors are third-party beneficiaries of these terms

8. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to:

  1. Monitor the Services for violations of these Legal Terms
  2. Take appropriate legal action against violators
  3. Refuse, restrict access to, or disable any of your Contributions
  4. Remove files and content that are excessive in size or burdensome
  5. Manage the Services to protect our rights and property

9. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy.

Data Location: The Services are hosted in India. If you access from other regions, you consent to data transfer to India.

10. TERM AND TERMINATION

These Legal Terms remain in effect while you use the Services.

Our Termination Rights

We reserve the right to:

  • Deny access and use of the Services to any person for any reason
  • Terminate your use or participation at any time without warning
  • Delete any content or information you posted

After Termination

If we terminate or suspend your account:

  • You are prohibited from creating a new account under your name or others' names
  • We may take appropriate legal action

11. MODIFICATIONS AND INTERRUPTIONS

Service Changes

We reserve the right to:

  • Change, modify, or remove contents at any time without notice
  • Make changes at our sole discretion

We have no obligation to update any information on our Services.

Service Availability

We cannot guarantee the Services will be available at all times. We may:

  • Experience hardware, software, or maintenance issues
  • Need to perform maintenance resulting in interruptions
  • Change, revise, update, suspend, or discontinue Services

We have no liability for any loss, damage, or inconvenience caused by inability to access the Services during downtime.

12. GOVERNING LAW

These Legal Terms shall be governed by and defined following the laws of India.

Jurisdiction: You irrevocably consent that the courts of India shall have exclusive jurisdiction over any disputes.

13. DISPUTE RESOLUTION

Informal Negotiations

Parties agree to first attempt informal negotiations for at least 30 days before initiating arbitration. Negotiations commence upon written notice.

Binding Arbitration

Any unresolved disputes shall be resolved by:

  • Forum: International Commercial Arbitration Court (Brussels)
  • Rules: ICAC Rules
  • Arbitrators: 1
  • Seat: Bengaluru, India
  • Language: English
  • Governing Law: India

Restrictions

Any arbitration shall be limited to the Dispute between the Parties individually. There is no right for:

  • Class action arbitration
  • Use of class action procedures
  • Bringing Disputes in representative capacity

Exceptions

The following Disputes are not subject to arbitration:

  • Intellectual property rights enforcement
  • Theft, piracy, invasion of privacy claims
  • Claims for injunctive relief

14. CORRECTIONS

There may be information on the Services that contains errors, inaccuracies, or omissions. We reserve the right to:

  • Correct any errors, inaccuracies, or omissions
  • Change or update information at any time without prior notice

15. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with:

  • The Services and your use thereof
  • Implied warranties of merchantability, fitness for purpose, and non-infringement

We make no warranties about:

  • Accuracy or completeness of Services' content
  • Content of any linked websites or applications

We will not be liable for:

  1. Errors, mistakes, or inaccuracies of content
  2. Personal injury or property damage from Services use
  3. Unauthorized access to our servers or personal information
  4. Interruption or cessation of transmission
  5. Bugs, viruses, or similar transmitted through Services
  6. Errors or omissions in content

We do not warrant, endorse, or assume responsibility for any product or service advertised by third parties through the Services.

16. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Direct, indirect, consequential, exemplary, incidental, special, or punitive damages
  • Lost profit, lost revenue, loss of data, or other damages

OUR LIABILITY TO YOU FOR ANY CAUSE WILL BE LIMITED TO THE LESSER OF:

  1. The amount paid by you to us during the six (6) month period prior to the cause of action
  2. 500 INR

Certain laws may not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some or all of the above disclaimers may not apply.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand including reasonable attorneys' fees, arising from:

  1. Your Contributions
  2. Use of the Services
  3. Breach of these Legal Terms
  4. Breach of your representations and warranties
  5. Violation of third-party rights
  6. Any harmful act toward other users

We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense.

18. USER DATA

We will maintain certain data you transmit for purposes of managing the Services. You are solely responsible for:

  • All data you transmit
  • Activity using the Services

Although we perform routine backups, we shall have no liability for any loss or corruption of your data.

19. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

You consent to receive electronic communications and agree that all agreements, notices, and other communications we provide electronically satisfy legal requirements for writing.

YOU AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS.

You waive any rights or requirements under laws requiring:

  • Original signatures
  • Non-electronic records
  • Payments by non-electronic means

20. MISCELLANEOUS

These Legal Terms and any posted policies constitute the entire agreement between you and us.

Key Provisions:

  • Our failure to enforce any right does not waive that right
  • We may assign our rights and obligations
  • We are not responsible for events beyond our control
  • If any provision is unlawful, the remaining provisions remain valid
  • No joint venture, partnership, or agency relationship is created
  • Terms will not be construed against us as drafter
  • You waive defenses based on electronic form and lack of signing

21. STUDENT DATA ACCESS AND VERIFICATION

Student Account Management

RoamEase maintains strict controls over student account creation and data access:

  1. No open registration: Students cannot self-register for accounts
  2. Institutional control: All student accounts must be created and verified by authorized hostel managers
  3. Data verification: Hostel authorities are responsible for validating student information before account creation
  4. Account lifecycle: Student accounts remain active only during verified enrollment periods

Data Retention Policy

Student data is managed according to the following protocols:

  • Active accounts are maintained while students are enrolled at the institution
  • Accounts are deactivated when students leave the hostel or complete their academic program
  • All student data is permanently deleted within 90 days of account deactivation
  • Hostel managers must initiate the deletion process for departing students

RoamEase complies with all applicable data protection regulations regarding student information. Institutions remain responsible for maintaining accurate student records and notifying RoamEase of any required account changes.
